Using your fallacy argument I can say driving a car is dumb, because what if someone is drunk, they can run off the road a die because of driving, or get arrested and go to jail for driving.

The system is broken and pathetic and both landlords and good tenant pay hefty price for that.i lost around 40k I will never get until he was arrested by police.

If drugs are an issue he can try to get the guy arrested off site especially if he knows  where he is selling stolen property or if he has drugs on him.
