Fundamentally I think that most people misuse metrics because they annualize them when the assumptions about how the money will work are dissimilar from project to project.

This same misuse of the term also happens with JV agreements but to a slightly lesser amount.Typically a fund will be setup as a Limited Partnership.

My lease says something like...if the damage is caused by the tenants misuse, abuse or neglect they are responsible for the reapirs.

Sobering to know that even screening tenants well and securing vacant property won't always protect you from criminal misuse and civil asset forfeiture.

It isn't so much that lawyers abuse the process, it is that people on the other end of the process aren't necessarily familiar with how to combat misuse of the process.
