Anyways, congrats on the buy, but I would just be careful going forward how we phrase things.With the hundreds reading this thread, its scary that one person may take equity out of another property thinking they got free money and end up being burned.

Without that silly phrase "time is of the essence", a court could do 2 things (assuming the matter went to court): A) NOT hold the other party accountable for failing to meet the May 1 deadline; AND, B) possibly hold you accountable if you back out of the deal because the May 1 deadline was not met!

Often times ESA is just a phrase tossed around because many people bank on the fact you may not be well versed on the law enough to realize this and they assume once the declare their animal is ESA you will not pursue the matter further (though you should).
