Get him to state he has an oral lease in writing (letter, email or text) with dead husband, then evict him (oral leases are legal in Florida) plain and simple.

When tenants move out I lightly sand and re-coat, either in spots or all over depending on the condition that they've been left in.I've had one set of tenants in there for 2 years after the initial refinishing and they kept them in great condition.

That would be a simple clause in the lease agreement he signed that stated he would forfeit some or all of his security deposit if the unit was not left in a cerntain condition.
