Maybe they feel they are being harassed because they follow a procedure where if they don't pay rent on the first, there is a late fee on the third, and a notice to pay or quit on the 5th..... and they feel they should have half the month for a grace period?

In this case it seems the board did not plan well major improvement cost and payments or even maintenance and so now they are raising the HOA cost per unit to raise the needed money but how does one prove the factual nature and scheduling of needed repairs, improvements or maintenance issues?

CapEx is to maintain or restore the original quality and nature of the property.What you are talking about is Capital Improvements - so assuming that your property has no deferred maintenance or life/safety issues, then the best way to determine what improvements to make is to go visit and tour the property that has the highest rent in your market and compare that to your.

However they replied that this is a common issue in the whole apartment therefore nothing could be done about it at that present time and just told me to be more cautious (So here they pretty much accepts the inevitable nature of the issue I believe?).

If I bought it, I would rehab it and use it as a vacation home and rental.It seems that some people don't trust remediation efforts to fully remove health hazards -- even if the remediation procedures follow state law.
