They are welcome to submit a complete application if they wish to remain and sign a new agreement with our terms, which may, or may not, be different from current terms, depending on our findings of condition, current market conditions, and their credit worthiness.Be sure you are getting the security deposits transferred to you at closing, and confirmation of rents/deposit with estoppel.

If the seller can provide either 12 months of documentation showing that they are getting funds deposited from you into the same bank account they use for payment of the mortgage, that could work.Or if the seller shows the lender that they have a contract with you, that may be able to work.I have not personally worked with a subto situation before, but I can presume that is how it would work.Good luck with everything!

Having recently received a threatening letter from an attorney regarding a disputed Security Deposit refund, I would love to bring in a stack of Testimonials and/or Performance Ratings from previous tenants.Don't know how much weight they would carry with the Magistrate, but I figure all ammunition is good ammunition!

(I think this is where you are) If sales proceeds fall short you bring certified funds check to closing for the shortfall.If you are selling a different property than the one with the HELOC and you get a "check" from the sale of the other property, you deposit your check and then pay off the HELOC if you desire.

You can allow it as well but state that if any damage such as fire does occur to the property as a result of the tree, the tenant will be held responsible and may have funds withdrawn from the security deposit to cover recovery and fixing costs.
