I'm evaluating a deal now, but it is typical for the sponsor to have a "30% of all distributions catchup" fee at selling of the property, this is after investor capital is returned, and a 7% preferred return is given to investors.The catchup fee is prior to the 70/30 split, and then after a 13% IRR is achieved, the split goes to 50/50

I mean it is disqualified from the tax treatment** You can borrow money and use it to buy things inside of an IRA, but it makes the income derived from said activities subject to immediate taxation at your ordinary income tax rate.

Just be mindful that the 401K distribution will be subject to A) Federal TaxesB) 10% PenaltyC) State TaxesIt may be more advised to take a 401K distribution in a year where you are not making as much money as your overall taxes might be lower.The question you have, is will the return on the real estate that you purchase, out weight the return that you will get in the stock market that it is invested in?
