I talked to one guy who said his house was going into foreclosure but talking to a friend who has access to MLS and looking around on the internet, the property isn't showing that its going into foreclosure.

Ask the title company what they need.What I might use in Missouri might get you in a bind in Cali, state requirements are not the same so asking for other people's documents or pulling crap off the internet is not the way to do business, see what is required locally, your title company can guide you.
