sure they can, but why if it's cheap money just to pay low APR and use the money elsewhere. you grow faster when you pay a portion over time instead of the whole amount upfront. kind of like leasing a car. a buy is 550, but a lease is 325. you get to use the 225 that you have left over for anything else you want.i am sure i am not explaining it the correct way, but hopefully someone can chime in.

An Option fee that is non refundable that is applied to the purchase price, NOT to be part of a down payment, can be spent.It is also tax deferred (see IRC 1234).You need good paperwork for lease options, and you should have an attorney take the money for the lease and option payments.NC has magistrates that MAY consider your lease option a disguised installment sale if you go to court.

Besides, you'd be better off using a note and deed of trust, not a rent-to-own or CFD. purchasing is more difficult for any note buyer, as Dawn mentioned, many will only buy payments as the contract has to go back to you to convey the property, otherwise they are buying the property subject-to and conveying title, few would do that.There are some who will purchase lease payments assigned, if it leases for 500 you might get a better deal doing several assignments of rents, but that would likely be small dollars in this property.
