That form is signed by the tenant and the seller so no issues after the sale.

I was considering asking tenant 1 to sign an addendum to remove tenant 2 from the lease and make them the only person who has 'occupancy'. 

I questioned this date, before signing the purchase offer, because we needed to move in ASAP, and the ad stated ASAP and the seller's Agent assured us he had already purchased a home and MOVED OUT. 

You will just end up backing out at the first signs of trouble, saying, "I told you so", and not going back. 

I know that it is my fault for missing this clause in the deed before signing so I accept that responsibility but my question is does the title company or realtor have any liability in this matter?
