IMO, it seems logical that the clause would become void if the original lender issued a freeze of the loan product they require you to use to avoid penalty.Thank you!

@Michael B.Hey Michael, you should be able to have a duplex that is that far away be considered a second home (primary residence) without an issue, especially when there is a perfectly logical reason for it.

I don't have logic to support my position there though.Hope that helps.
