Any advice on how to best handle a situation in which tenets don't pay citing the law or for screening future tenets to prevent this?  

If I need the permit, will that prevent the tenants from moving in next week ?

It's a really intriguing concept, but my guess is that if it's been done before without negative consequences, it's because the implementation hasn't made it to any form of IRS review, and not that the IRS would "bless" the approach.
