Hindsight is great, but until the deposit is in hand, the lease isn't valid.

I had a tenant who had a Surety bond with Assurant for the security deposit, but they are getting out of the business and are not renewing any of their policies.

Not sure if this belongs here or in Legal, but anyway....I mailed out a returned security deposit (via certified mail), but the former tenant never picked it up/signed for it so it was returned to me. 

Minimum deposit was $1K.

I suspect that full security deposit forfeiture for lease violation may not be legal.  

I'm all ready to go ahead.So, I recommend the Holding Deposit.   

Coincidentally the list of repairs they emailed her equals the amount of her security deposit. 

An agent has a clear ethical duty to be upfront with their client about the mistake and the potential loss of the deposit.
