Title Issue w/ Past Divorce
The home I’m in the process of buying was awarded to the seller (paid off) in a previous marriage. The seller is now about to go through another divorce with the new spouse. The new spouse is not listed on the deed along with not lived at the property for 2 months.
After the seller spoke with the attorney the new spouse has no right to any proceeds from the sell and or the home because it was awarded in a previous divorce. Title is saying the opposite. They're requiring the new spouse to sign closing documents (which the new spouse will refuse to sign).
Any guidance on proceeding with this when attorneys say one thing and title says another? From our understanding, If the house was awarded to you solely in your previous divorce, your current spouse's approval is not required to sell it, provided they’re the only person listed on the deed.
