NOT RENEW THE LEASE ?

My tenant's lease will expire on Dec 31, 2013. I suppose to serve them 60 days notice not to renew the lease on Nov, 1 2013. Can I serve my tenant on Nov 5, 2013 after they pay my November's rent ( hopefully )? I am afraid that if I serve them on the 1st of Nov, then they won't pay me for Nov. Any advise would be appreciate.

No, just get rid of them. They don't pay unless forced. They don't communicate. They're causing problems. Serve the Notice, and serve it right. Give them no way to fight you about it.

In fact, serve the notice that you're ending the lease, but also go ahead and file for their late rent that no doubt will happen next week.

I'm not sure on laws where you are, but in Baltimore County, after a tenant has four rent judgements against them within 12 months (not need to be consecutive and no matter if they've paid up), you can file for eviction without right of redemption...which means they'll get evicted even if they pay.

If you don't know for sure, read read read your rental laws!

And bottom line, get rid of them. Even if they don't pay, you can either evict faster than the 60 days maybe or they'll be out by the end of the lease anyway. And if they hold over the lease, you will have that evict date setting up in the background because you knew they wouldn't pay. See what I'm saying? Cover all bases to rid of them as soon as possible!
