Conflict of Interest Question: Should I Represent Myself or Find a Buyer’s Agent?

Hi everyone,

I’m interested in two side-by-side duplexes (four total units) in Fort Collins, Colorado. The issue is that my current agent’s brokerage owns and is listing both properties. He and his group has a direct financial interest in the sale and cannot represent me. 

I’m aware this creates a conflict of interest, even if disclosed, and I’m trying to decide whether to:

  1. Find a separate buyer’s agent to represent only my interests, or

  2. Represent myself in the transaction and deal directly with the listing side.

Both properties are listed at market price and I've already toured them, so the question comes down to negotiation strategy and legal protection. For context, this would be part of a 1031 exchange from a California SFR into these Fort Collins multi-family units.

If anyone has navigated a similar situation, especially investors who’ve dealt with a listing brokerage owning the property, I’d appreciate your insight. How did you handle representation and ensure fair negotiation?

I'm happy to take a look at the deal from an investor perspective. 

can you share the property address?

ultimately the numbers should dictate your decision. I would also recommend investing in class A or B rentals in Fort Collins and or student rentals. Rents are dropping and vacancies increasing and you want to select a rental investment that will be more desirable than a basic 2 bed 1 bath unit.
