Assigning homes under contract with realtor?

I'm seeing that a great market to pursue is sellers who's home has been on market for 90 days or later and is eager to sell. My question is can I get a seller under contract when they are represented by a real estate agent? Do I have to wait until contract expires? Can I make a deal with the realtor? I live in Texas. Thanks everyone
