Text message marketing campaigns?

Hello all, 

I am looking into new (to me) forms of marketing for off-market leads. I came across text message marketing and it sounds great. I've also come across a lot of people saying that it may be illegal. Is anyone here currently using this system with success? Are there ways to do it legally? I live and operate in Western NY.

 It is 100% illegal under federal telecommunication laws (TCPA). The companies offering the service shield themselves because they are just a service, not the sender. In other words they believe it is not illegal for them to send messages for you. It is illegal for you send the messages. You have to have a pre-existing relationship with the individual and they have to give you consent to text them. 

There has been an increase of people using this strategy, which is guaranteed to attract government attention and class action litigation.
