2nd Time FHA buyer, 3 years from date of sale or recorded date?

So our buyer was foreclosed on over 3 years ago.  Unfortunately, the bank never recorded their deed from the sale and took 2 years to get it sold.  I suppose it's lender to lender, but does anyone have any advice for us/our buyer?
