CDC COVID Declaration Form - Time Limit/Deadline

So my attorney tells me that he won't file for foreclosure because the Sept CDC order  (Temporary Halt in Residential Evictions To Prevent the Further Spread of COVID-19) does not provide a deadline or time limit for the residents to complete the Declaration. 

I know, I know. I can hear you already. FIRE THE ATTORNEY!  

They are now working on 3 months with out paying anything. Thoughts? I'd really like to know if anyone else has encountered this issue?

@Kyle J. agreed that giving up is not an option. Really looking to find the folks that have successfully evicted or foreclosed for non-payment not for reasons not related to COVID. Do you have you this experience? 

@Ron S. we actually have one of each. Both not paying and not as a result of COVID. We even provided the CDC Declaration Form. They did not return it filled out.
