Estate hasn't opened probate

Hello BP,
I have found a house that has a small mortgage against it and a medical lien. I'd like to purchase the house and payoff both liens since the lender is foreclosing. However, there hasn't been a probate case started. Can I still contact the heirs and purchase directly from them or does a probate case need to started? Any helps would be great, thanks!
