Cash-Out Refinance Transactions - Delayed Financing Exception

Trying to understand this fannie rule (https://www.fanniemae.com/content/guide/selling/b2...) 

If I use a hard or private lender, can I perform delayed financing?  Or is that only available when I pay in cash.
