refinancing for cash- can't purchase for a year???

Hello, my husband and I are planning to refinance our home, pull money out to use toward a down payment on the purchase of a second home so we can rent out our first home.  Is it true that we have to sign something that we plan on living in our house for a year? Any advice or tips regarding this matter?  We are planning to refinance now and purchase a second home in about six months.  Thanks!!!
