Buying home from grandma with POA

My husband and I want to purchase a home from his grandmother who has a POA (Husband's brother) due to her age (95) and condition. It is damaged on inside selling for $20,000.00 bank walk around outside evaluation says value is $90,000.00. Attorney doing title search etc says due to elder laws he will not do it because it looks like it is only 22% of the fair market value. Anyway around this?
