wrong HVAC installed when before i purchased the house

So I'm hoping this isn't just a lesson learned event...but when I purchased my rental near joshua tree, the homeowner was to put in a new HVAC system prior to closing. The house uses propane, but the unit installed was for natural gas and it started a little fire and fried all the circuitry.  I'm told by the HVAC tech that he talked to the manufacturer and this unit specifically does not work with propane and can not be converted.  Do I have any recourse here?

Thank you @Kevin Sobilo. I am waiting to hear back from them so hopefully it will go smoothly dealing with them. @Andrew Syrios yes it was in the contract.
