Real Estate Commissions, 501.C.3 Orgs and Respa

So we know the following:

1) A loan officer, title rep or other ancillary service provider cannot pay a RE agent a "kickback" or otherwise provide items of value as part of an ongoing business relationship.

2) An RE agent cannot pay or otherwise provide items of value to an unlicensed person as a referral fee.

But- what I don't know is what (if anything) is to be done if a RE agent makes a donation to a 501(C)(3) org.

What if he does this more than once? What if he does this more than once with the expectation of receiving future business from members of said 501(C)(3)? What if he does this more than once with the expectation of receiving future business from members of said 501(C)(3) AND IS ALSO A MEMBER of said 501(C)(3)?

Perkins, et al... care to enlighten?
