Solo 401k distribution question

Good Morning all,

I am not close to retirement age, and have a question about my Solo-401k account. It was opened in 2005 when I was self-employed, but have not really contributed to it since 2006 when I took up regular employment. Now I'd like to self-direct the funds but the options provided by the company are limited. I would prefer to roll the funds over to my IRA and gain more control. Can you all please answer a couple of questions?

  1. Can 'Plan Termination' be the reason for this distribution?
  2. Will the distribution subject to taxes and/or penalties
