NMLS Test Violation Questions/Help needed

My boss recently took the NLMS test and got a violation letter. English isn't his first language and although I am not excusing him( he really should have read carefully all the rules) I still want to help him. He asked me to write a letter to the registry in his defense. Here is his side of what happened? Any suggestions on how to deal with this? Basically yeah he don't read to good but I don't want to write a letter that says that. We are working hard to get a mortgage company going to loan money to all y'áll investors and this puts a pretty big damper on it.
Here is what he says:

"" i got permission to use the restroom , but after restroom i went to my locker to get a sip of my Gatorade as my sugar lever and blood pressure usually drops when under exam pressure.
Apparently its against the rules to go to the locker during restroom allowance.
This rule apparently was mentioned when u login to the exam and i accepted the rules to be able to start the test. But obviously i kind of skipped the part that doesn't allow me to open my locker."

I don't see any defense really in this but hoping some more legally savvy people might have a spin or some comprehensible defense for this. I have to write the letter today.
