Lawyers in the area experinced in lawsuits due to rent loss?

Posted

I am looking for lawyers help in taking a tenant to court for the debts owed. It exceeds the limit for small claims. Ids there anyone here experience with this process and may have a recommendation?

@Phillip Pennington, the issue with suing most times is NOT in going to court. Its in collecting on the debt. Unless the tenant has significant assets like real estate to go after its very difficult to ever collect on the judgement.

If the tenant has real estate or IF you believe they will want to buy a home in the future, then it may be worth hiring a lawyer because you MIGHT have a chance to collect a larger judgement.

However, if they are an average tenant where collection is unlikely, then I would proceed to take them to small claims court and get a judgement for the maximum there because that is cheap and simple.

This may differ in your area (I thought I was posting in Louisville specific but I may have messed that up) but here small claims is only up to $2,500 which this debt exceeds. Im aware collecting isn't easy but I would like the have the judgement in case I decide to garnish wages
