Converting an apartment with a tenant that won't leave?

Hey guys I have a tenant (inherited) in Rochester that hasn't paid rent since I bought the property in January.  She is on a month to month lease. Can I legally change it to shared apartment with her still there. Prior to purchase I was told that it was this way before and her and her ex boyfriend took over the whole unit. Thanks for your help.
