Smokers...

I have a duplex (older home that is split into a duplex) that I rented one side to a chain smoker. The smell spreads throughout both sides of the duplex. Can I legally not rent to smokers? I thought the answer was absolutely not, but after hearing some other landlords discuss this issue I am wondering if there is a legal way. Thanks!
