Accidentally paid landscaper extra check and now I can't reach him

Ugh. What a dummy I am. I was rushing to get out of town and to complete my landscaping before that. I accidentally sent my landscaper an extra check for $2100 and now when I reach out to him to have it returned, I can't get him on the line. I have sent him many emails, texts and payment requests using SparkRent.

What are my options?

I could go to his place of business but I doubt that he is even open during the winter. Should I just file with the courts and collect that way? How will a court look at this overpayment?

Any help is appreciated.

Ouch, that sucks. If he's already cashed the check and you think he's trying to avoid you, maybe you could have a friend call him posing as a customer and get him to come out to a house and "bid" on a job. If he shows up, it'd give you a chance to talk to him in person and try to work it out.

If that doesn't work and he still avoids you, you're probably going to have to go the small claims route. Of course he's still going to need to be served that paperwork. So either way you're going to have to track him down.
