New property law suit in progress

Hey everyone, So I identified a four plex for my 1031 exchange and then put it under contract. This will be my fourth property but as I was about to submit my Ernest money and option money. The current owner discloses that one of the tenants is suing them for a bogus slip and fall. She also tells us that if I want I can evict them right away because they're violating their lease by running a home business out of their apartment. So I guess do I run away from this deal? Go forward and begin eviction proceedings the first week? Or option 3? Thanks again!
