Keep all of Last Month's Rent if Tenant leaves early? (MA)

Our tenant (Leased) signed a termination agreement and plans to leave early in the Lease period. We have yet to sign, but there is a clause that have us refund the Last Month's Rent (which the tenant paid at the beginning) for part of the month after the Termination Date, which is mid-May. The tenant gave us notice 20 days ago, so end of April. The tenant also claims that it is against the law to not refund part of the last month's rent. My question is for MA specifically, will we have any liability if we change the termination agreement so that we keep all of the last month's rent? Thanks in advance for the help.
