Holding security deposit for pool

My tenant had the pool closed before the winter, as per the lease. Now, they are moving out too early in the year to test if there is any damage to the piping due to incorrect closing. In NJ, the deposit has to be returned within 30 days. Can I hold any of the deposit until i verify that the pool is not damaged? Thanks

Hire a pool company to handle the pool maintenance.

In court, the judge will ask if the tenant was trained and knowledgeable enough to "close the pool" properly....how and who trained them? How many years of experience? Were very detailed written instructions given?

Even with some basic training and written instructions its very unlikely the judge will side with you.....

Plus you cant hold back past the legal time "just in case".....
