I need help in NYS with understanding my rights.

I was trying to help my niece out by allowing her to rent my rental home. Things were good between us. She moved in a week ago and still has things at her old apartment. I didn’t have a lease signed because I’m new to this and I am still looking for a lease agreement that makes sense for us. We just closed on the house a week ago. Today when I went over to say happy Mother’s Day, I caught her in a lie... again. I told her she had to get out. She had people there doing drugs and all these kids running and out of control . I called the police because my niece is saying I can’t convict her. We don’t have a lease or any document signed. She hasn’t even paid full rent yet. The police told me I had to take her to civil court and evict her that way. How in the world does it make sense that my niece has more rights to my home than I do?
