So my neighbors townhouse completely burned out to a shell. The is no actual fire damage to my house (Vacant rental) but the FD kicked in my door, broke a couple windows and poked holes in the ceiling and roof. Theres also water seeping in the basement from next door. Shouldn't the neighbors insurance have to pay for the damage to my house??? I called USAA to let them know what happened but they're telling me I have to pay my deductible?? I'm lost, shouldn't the neighbors insurance have to pay for the damage to my house??

You can make a claim under your policy and pay the deductible, you'll sign a subrogation agreement allowing your insurance company to collect from your neighbor's policy.

Or, contact the neighbor's company and ask tem to cover your damages, they can without you paying any deductible.

Or, you can file suit for damages against the neighbor and their insurance company will defend them under the liability portion of their policy and cover costs. sounds like you would have no problems with this route but you need to speak to your attorney.

Sorry to hear, stuff happens, Good luck
