Does a text hold up in small claims court

Joni Maurer
Posted

Tenant's lease ended on 7/31/20.  They sent a text saying their lease ends in August and would be moving out at the end of it.  Their entire deposit was used for damages.  Can/should I sue in small claims for August rent?

To the first question:

"In small claims court, claims less that $5000, text messages can be used. The rules of evidence are relaxed and almost any evidence you have will be admitted by the judge."

Second question:  Yes.  The tenant's lease is in writing, right?  The owe August rent.  Go get it.

Hope this helps.
