Hi there - I just purchased my first multifamily property that is occupied by tenants. At the end of the month one of my tenants is moving out as per my request/notice and I want to make sure I dont get into any trouble down the road. Do I need to get any signatures from the tenant confirming he is vacating/surrendering? Its not a lease break, as he was on a month to month lease. Any help/insight would be very helpful
If the place is empty after they move out you should be fine. Take some pictures.
It can't hurt, but it isn't strictly necessary. Generally you'll meet with them at the time of move out, verify the place is vacant, and they'll give you the keys.
@ Kevin Nolan, As long as you have a copy of the notice(email, certified letter etc) to terminate the lease and their receipt of the notice or acknowledgement you should be fine.
