STR Deed Restriction

Hey all!

I am looking at a property and found out that the owner is intending on putting an STR restriction on the Deed prior to closing. I have inquired to why, more to follow.

My questions:

1. If I cannot prevent the deed restriction, can it be removed? This is a personal restriction not HOA based.

2. How is this restriction enforced?  If it is attached by seller, is seller responsible for enforcing it?

Regardless of ultimate enforceability, this is not a property worth pursuing.  You are openly inviting a world of future headaches.  Why bother?  Find a property that is unencumbered by deed restrictions.
