Lease option In Texas

A few years back I did a lease option on one of my houses in Texas. The tenant had 3 years to exercise his option to buy , buy failed to. The option expired above a year ago and so did the lease. The tenant is still in stated property and on what turned into a month to month lease. The tenant has been paying late and has fell behind almost three months at present and is giving me the run around and sad stories.

My question is to a Texas investor that is versed in Lease Options here. Do I proceed to eviction like any regular eviction or not?

You almost certainly have an executory contract and, as mentioned earlier, if you didn't have an attorney assist you initially, you will certainly want to hire one ASAP. The burdens placed on the seller under Texas lease options are horrendous and the penalties for not following the steps involved are barbaric. Seek counsel immediately.
