San Jose: Permit requirement for deck+patio cover?

Adwait G.
Posted

Hello!

I have looked at the San Jose codes but did not find a clear answer to the following question. Please let me know if any of you have a clue :)

Does the San Jose city require a permit for the below two structures?

1. Wooden deck less than 30 inches above ground, attached to the house in the backyard, with more than 20ft rear setback and 10 feet side setback from property line.

2.  Patio cover of 120sqft over this deck that is attached to the house. Not an enclosed patio cover but an open one with just the roof.

Generally, any structure will require a permit, but you should call the permit center and ask them directly. Any advice given here will not limit your liability or risk.

Anything under 120 sq ft doesn’t require a permit - but I would double check with a call 408 535 3555

If you do not nail to the main building it is safe to state you do not require a permit. Attached needs a permit but it takes long to process. Check the cost of filing.

Anything layover the house with a roof needs a permit. That is why people have a Pergola as stand alone deck.

As stated by others in this forum, in San Jose you generally don't need a permit for smaller structures of the size you mentioned on your property but just to be safe, I would call the permit center and inquire with them.
