rebuilding shed/accessory structure -- NOT ADU

Ed Dere
Posted

I currently have a shed in my backyard that is in pretty bad shape and I'm interested in rebuilding it as an accessory structure again (i.e. not an ADU) on the same footprint and having it as a home office. It's about 160 square feet and sits right up against the rear and side property lines. This is an older house with no permit history for the shed, and every house on the block has a similar shed.

I've read that if I convert the space to an ADU that it would fall into Category 1 and would not be subject to setback and height restrictions (RM-1 zone). My plan is to tear it down and rebuild it as an office (NOT an ADU). Will I be able to rebuild on the existing footprint without any setback restrictions, or does this only apply if I rebuild it as an ADU?

Thanks
