Tenant breaking lease
I am in Buffalo NY. Tenant is month to month, lease states 60 day notice to end lease. Did not pay month of September. Did not give notice and said they will give me the keys on September 12.
Can I enter the apartment at that time? Do I have todo an eviction? Do I go to small claims court to get my money for not following the lease?

@Nicholas Nikel If they were otherwise a good tenant and didn’t damage the apartment keep the security deposit for September rent and just move on. In my opinion it’s usually not worth it trying to collect one months rent from a tenant after they’ve moved.
