Tortious Interference Fears

Hey guys,

If I see a property on the market for a REALLY long time, is there a snowballs chance that I would be able to call the listing agent and just say "Hey buddy, any chance you would let me wholesale that property since you aren't doing anything with it or making a commission on it now anyway? and he/she says "Sure! Be my guest!"?

Or would a more likely response be "Get out of my face, you jerk! I am going to treat this 10,000 day old (DOM) listing like it's my first born child! You're lucky I don't sue you for tortious interference!"?

Sorry if this is a dumb question. Just something that popped into my head one day...

You don't make deals with the listing agent...it's not his/her right to enter into agreements with you. What you can do is make an offer to the seller and let the seller decide whether to allow you to try to wholesale the deal or not. Of course, it will be easier if the agent is on your side, but ultimately, it's up to the seller, not the agent.
