I am a Wholesaler in Real Estate, if i have a property under contract with an equitable interest, can i list the property on MLS even if I am not the owner. If the answer is NO, where is the law? This is in Texas. Please advise.

It is determined by local MLS policy, not laws. Typically, no.

It's possible in some Mls' in Florida. Not sure about Texas. But with a market this hot, you almost don't need it.

When I started wholesaling 12 years ago it was very taboo. I don't wholesale anymore but I know quite a few wholesalers that list on the MLS as common practice.

Think it's kinda BS on your behalf, but as noted MLS is a private service and they control what goes on the MLS. Who knows? They may have some morals and require that you disclose to the seller what the true buyer is paying or that you may need to have a RE license if you arrange a sale in expectation of a fee. Then again equitable interest is NOT ownership, so they may need a valid listing from a seller to market the property. But hey, as long as you can make a skim I guess it's OK.

In North Carolina, I have seen it done. Usually listed FSBO. It was always said "assigned contract" or "Equitable Interest". Illegal...I would assume not if they are being allowed to post it, but, following in the event someone knows more!
