Update: the sister got the brother to sign the contract and to make him aware...will ask her for his contact to verify with him and make the title company verify it as well.

Few days ago before I get the heirs under contract I went to the property and talked to the neigubour he was so nervous and looked pale when I told him im buying the property he said I was taking care of the property since the guy passed away and I hired an attorney and spent 15k on it and mowed the grass all the time and now the city is on my side...now you show up and wind everything!!! Thats what he said...Im just worried if he is gana creat any problem...you mnetioned anybody can pay the taxes what if he goes and pay them before I close will that give him any right in the property? Im just trying to see what kind of things he might be able to do that could effect me in a way or another.

The property is vacant now but he has his cars parked in the drive way.

Another thing Im trying to go see the property from inside can I do that since I have it under contract...the contract says The owner needs to let me in for inspection but the sister doesnt want to go there...can I get her permission via text message will that be enough...no body has keys but one broken window which I can get in through!!!

Thank you all for the info...I think here in Texas the accept an affidavit of heirship to avoid the probate route...will see what would the title company do and will post here hope everything goes smooth.

Thank you Mike for your reply...may be I didnt explain it right but regarding the POA or Quit claim deed I was refering to the living brother signing one of them to make the living sister to take care of the signing at closing since he cant make it to the title company.

Will stick with the title company because when things get unclear to me I always follow the experts which is the title company in this case

Hi BP, I found a property thats supposed to be foreclosed on next month due to behind taxes...I reached out to the owners basically the owner is deceased and didnt leave a will no wife or kids...only a brother and a sister alife...talked to the sister and got her under contract she promised to get her brother to sign also.

For some reason the sister doesnt want the brother to be involved in the closing sounds weired but she said they dont go along with each other basically there is a reason she is hiding from me anyways she said she can get him to sign her a power of attorney or a deed transfering his share to her and she can do the signing from that point on.

Talked to the title company they said the underwriter wont accept POA or a quit claim deed in this case dont know why! Besides all of that there will be a need of affidavit of heirship.

This is my first time dealing with such situation were heirs involved...any guidline to follow when doing the affidavit of heirship? Is that common thing for title company to refuse POA or a deed? What if things didnt work out at title can I get them both to sign general warranty deed to me and I record it...I know I will be responsible for all liens but how can I make sure that no other heirs are the sister is not telling me about? Will the affidavit of heirship help to protect me if I missed one of the heirs.

I know lots of questions here but hoping to find some answers.

Regarding what you can build I think that depends on the zoning...better to check with the city.

Still the land will be redeemable based on 6 months - 2 years (agricultural)

Hi Bp...was thinking recently to buy a property from a whole seller...not sure if anything I need to avoid or be cautious about before getting myself into contract...I noticed most of the whole sellers not all of them...they way under estimate the rehab and pick the highest comps or some times they base their ARV on the for sale properties available on the market not the sold comps !!! I'm trying to understand the whole thing since its gana be my first time using this method.

Any insight would be appreciated.

You can buy the right of redemption by signing the former owner/owners a waiver or the best is to do it through a deed because sometimes there is possibilities to fight the waiver at court or title attorney may not accept it (that's what I was told by my attorney)...still everything has to be notarized and recorded for your protection.

Check these guys don't know why I can't find their 3 online courses but call them and ask its like $60 each course and they are helpful to understand the basics... (4closure dot info) (not making any kind of advertising here and not sure if I should put links here ... if not allowed by BP then I apologize).

That's correct the very minimum to make it habitable so you can rent it out...in case the redeemer didn't agree with what you paid for the rehab I heard the judge will give you only basic standard $ for what you spent for example you put granite countertops you won't get the $ you spent for that instead you may get what a tile or Formica countertop worth if the old one wasn't salvageable.

having all receipts would always be a good idea.
