I would just add the caveat to the @Wesley Sherow comment, hard money is not lent on owner occupied, nor to natural persons.

You can buy any property before foreclosure, because the owner still owns the property. Be prepared to bring the mortgage current.

why not use the Find an Agent tool here on Bigger Pockets?. After all, they will do the work and the seller will pay the fee.

Contact the lender.
It will set up a draw inspection.
After inspection of completed work, the draw should issue.

Which state is the property in? That might assist me possible responses.

 The property can be behind in payments for many reasons but often if the property is behind in payments there could be issues of neglect. Think of it this way :if they could afford to make the payments they could afford to keep it up and if they can't afford to make the payments they might have a difficult time in keeping it up.
