Does that not presuppose that one has a 401k? Or is there a way to transfer IRA monies into a 401K?

I use a self-directed IRA for such investment purposes.
Be advised that you yourself may not manage such properties nor may any monies other than self-directed funds be used in furtherance of same, nor may you have any legal interest in any entity involved in any way with the property.
Search out a self-directed entity for investing.

Only a legal representative can sell the property; this person is usually appointed through the courts. With a will for the decedent, the court appoints the executor/executrix named in the will. Without a will a different more lengthy legal proceeding is undertaken to appointed what us often called an Administrator. This person is determined by the court, often after a review of  family tree. If no family, another court appointed person is named. In NY, this individual is the Public Administrator. ( each state has its own variation I'm  sure).
Just call whatever court system is involved.  But first you need to determine if there is a will or not and proceed accordingly from a legal perspective.

2. You say that you did internet research and chose the best offer, yet you are conflicted by your findings. Without letting us know your findings, you are asking for analysis without information.

"Reasonable rates" is a subjective, comparative term. What is reasonable for one may not be for the other.
Imagine... same property, two offers.
one with 640 credit and 3 flips and the other with 740 credit and no flips. Should they have the same points to get the same money... are their needs the same?

Imagine a cash out refi ... might it be worth 1/2 point more to get $40k more?

Many hard money lenders require some/all of the member to submit to and sign on for/as loan guarantors.
That being said, dittos to @Scott Mac
