As @Don Meinke mentioned, it sounds like there may be a vent problem... perhaps @David Doyle can chime in on this one?

Unless there is a problem with the existing insulation, typically just adding to it is fine, although be sure that there isn't a barrier (e.g., plastic, paper, foil, etc.) of any kind between the old and the new and that if your area/code requires ventilation of the attic, that the new insulation doesn't interfere with such.

@Ryan Cormier, if you're going to ensure that it is a legal apartment, then I suggest you go meet with the local building department.  There's plenty of advice available here on BP, but at the end of the day, the local officials are going to govern what needs doing.

Some things to think about... do the toilet clearances meet code, does the sleeping room(s) have proper egress, is fire separation required, are smoke alarms interconnected, etc.
